PHELAN – A 53-year-old Phelan man was shot and remains hospitalized after threatening to shoot a Victor Valley station deputy on Thursday afternoon. Sheriff’s officials said that at around 2:14 p.m. a deputy spotted a vehicle belonging to a subject with an active misdemeanor arrest warrant in the 9800 block of Sierra Vista Road in Phelan. The arrest warrant was a result of charges related to an August 2015, possession of methamphetamine and possession of drug paraphernalia arrest.
The driver, Richard Kelley fled on foot when the deputy attempted to make contact with him. While running Kelly told the deputy that he was armed with a weapon. The deputy ordered Kelly to stop, but he continued running and attempted to hide in a bush authorities said.
When the deputy located Kelley, he pointed a gun at the deputy. The deputy fired his weapon at Kelley hitting him in the upper body. The handgun was recovered and taken as evidence. Kelley was transported to a local hospital where he remains with non-life-threatening injuries.
As part of the protocol, for deputy-involved shootings, the Sheriff’s Homicide Detail responded to conduct the investigation. When Kelley is released from the hospital he will be booked into the West Valley Detention Center for assault with a firearm on a peace officer and the $100,000. warrant for a domestic violence incident.
