Rialto Man Sentenced to 155 Years for Rape of Juvenile Family Member

SAN BERNARDINO – A Rialto man was sentenced to 155 years in state prison for the sexual assault of his 15-year-old sister-in-law, officials said. The sexual abuse took place for two years until the victim reported the incident and met with a detective from the Los Angeles County Sheriff’s Department at the Pico Rivera Station on October 9, 2013, when she was 18-years-old.

The now woman, who will be referred to as Jane Doe, for privacy reasons told detectives that Carlos Hernandez sexually assaulted her starting when she was only 15 years old and Hernandez was 30-years-old. A Rialto Police detective became involved when the victim disclosed that some of the assaults happened in the City of Rialto, DA officials said.

The assaults began during a summer vacation when the victim visited her sister and brother-in-law for a couple of weeks. On August 2, 2011, the victim testified that Hernandez went into the guest room and began rubbing her thigh. Uncomfortable with his advances, the victim told him no and pushed Hernandez away. Still, Hernandez forced his hand down her pants.

“Jane Doe never screamed for fear that her young niece and nephew would walk into the room and see what their Dad was doing to their Aunt,” said Deputy District Attorney Morrissa Cardoza, who prosecuted the case. “She was too afraid to tell her sister and break up what appeared to be a happy family, so she continued to keep the Defendant’s secret.”

The following night he went back into the guest room where the victim was staying, this time, Hernandez raped the victim and did the same the next four nights. He assaulted her several more times over the next two years at her Los Angeles County home as well as the Rialto home.

Although Hernandez took the stand adamantly denying the accusations, the jury found him guilty of 15 counts of sexual assault on April 20, 2016. The charges he was convicted of included five counts of Forcible Rape-Child Victim Over 14 Years, five counts of Forcible Oral Copulation-Minor Victim Over 14 Years, and five counts of Sexual Penetration By Foreign Object-Minor Over 14 Years.

Hernandez was sentenced on Wednesday to 155 years in state prison.
